NFA FAQs Frequently asked questions
Q: How long will it take to get the tax stamp approved?
A: NFA processing times vary wildly and fluctuate during peak seasons. Currently, we’re seeing an average of 3-7 business days. We cannot guarantee approval times. Contact the NFA Division with questions pertaining to pending submitted forms. (304) 616-4500.
Q: Who can Own NFA items such as silencers, short barrel rifles/shotguns, and machine guns?
A: Generally speaking, anyone 21 or older who can pass a regular background check for a firearm, as long as the NFA item is legal to own in your state.
Q: Why is there a $200 tax?
A: The National Firearms Act (NFA) requiring the $200 tax was passed in 1934 and has remained unchanged ever since. The approved form will have a “tax stamp” attached to prove that you paid the tax and are the legal owner.
Q: Do I have to renew the tax stamp every year?
A: No, the $200 fee is a one time tax per item.
Q: How can I check on my stamp application?
A: You can call the NFA branch of the ATF. You will need the name of the transferee (you), the name of the transferor (Armory 219 LLC) and the serial number of your NFA item. (304) 616-4500.
Q: Does Owning a NFA item mean the ATF can come into my home and inspect my guns at any time?
A: NO! This is a common myth circulated around gun shows and the internet. You do not give up your 4th amendment rights by owning a NFA item. ONLY FFL’s are subject to periodic inspections by the ATF.
Q: What happens to the item when I die?
A: The NFA item will pass to your heirs on a tax free form 5.
Q: Do I need a trust?
A: A trust is not required. Trusts add complexity to the NFA process and are usually not needed. There are several common misconceptions surrounding Trusts (nobody reads or understands their own trust) and what affect they have for the NFA item. A TRUST DOES NOT AVOID THE FORM 5 TRANSFER AFTER DEATH, SEE THE QUESTION ABOVE. An attorney should be consulted to determine what is best for you. If you decide that you would like to use a trust we can assist with the process.
Trust processing will incur a $40 fee due to the added complexity of the submission.
Q: Can I make a machine gun?
A: NO! The manufacture of new machine guns for civilian ownership was banned in 1986 (thanks Reagan.) Machine guns legal for civilian ownership had to be made AND registered as machine guns before May 19th,1986.
Q: What happens if I'm denied?
A: In the rare event that you are denied, the ATF will refund your $200 as the taxable event is the transfer, not the application. Armory 219 will resubmit your forms once you have cleared up your background check. This is usually done by applying for a UPIN. See our store policies.
